ClickOps — Terms and Conditions

Please read these Terms and Conditions carefully before using the ClickOps mobile application operated by BPS Dynamic (PTY) Ltd.
1. Acceptance of Terms
By downloading, installing, accessing, or using the ClickOps application, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use the application.
2. Description of Service
ClickOps is an educational quiz game designed to help users learn and identify Amazon Web Services (AWS) cloud service icons. The application includes timed quiz rounds, scoring, leaderboards, leagues, user profiles, and progression tracking.
ClickOps is an independent educational tool. It is not an official AWS training product, certification exam, or certification preparation course. Performance in ClickOps does not qualify users for any AWS certification or credential.
3. Eligibility
You must be at least 13 years of age to create an account and use ClickOps. If you are under 18, you must have permission from a parent or legal guardian to use the application. By using ClickOps, you represent that you meet these eligibility requirements.
4. User Accounts
To access certain features, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You may register using email and password, or through third-party authentication providers including Google, Apple, and Facebook. Your use of third-party authentication is also subject to the respective terms and privacy policies of those providers.
You agree to notify us immediately of any unauthorized use of your account. BPS Dynamic (PTY) Ltd is not liable for any loss or damage arising from your failure to protect your account credentials.
5. User Conduct
When using ClickOps, you agree not to:
- Use the application for any unlawful purpose or in violation of any applicable law or regulation.
- Attempt to gain unauthorized access to any part of the application, other user accounts, or any systems or networks connected to the application.
- Use automated scripts, bots, or other tools to interact with the application, manipulate scores, or gain unfair advantage on leaderboards.
- Submit false, misleading, or offensive usernames or profile information.
- Harass, abuse, or harm other users.
- Reverse engineer, decompile, disassemble, or attempt to extract the source code of the application.
- Reproduce, distribute, or create derivative works based on the application without prior written consent.
- Interfere with or disrupt the integrity or performance of the application.
6. Leaderboards and Scoring
Scores, rankings, streaks, and leaderboard positions are determined by the application based on quiz performance. BPS Dynamic (PTY) Ltd reserves the right to remove, reset, or adjust any scores or rankings if we determine, in our sole discretion, that they were achieved through cheating, exploitation of bugs, or violation of these terms.
Leaderboard usernames are visible to other users. Do not use your real name as your username if you wish to remain anonymous.
7. Intellectual Property
The ClickOps application, including its design, code, graphics, user interface, sounds, text, and all other content created by BPS Dynamic (PTY) Ltd, is the intellectual property of BPS Dynamic (PTY) Ltd and is protected by applicable copyright, trademark, and other intellectual property laws.
AWS service names, logos, and icons referenced within the application are trademarks of Amazon.com, Inc. or its affiliates. Their use within ClickOps is for educational purposes only. ClickOps is not affiliated with, endorsed by, or sponsored by Amazon Web Services or Amazon.com, Inc.
8. Third-Party Trademarks
All third-party trademarks, service marks, logos, and brand names appearing in the application are the property of their respective owners. Their inclusion in ClickOps does not imply any affiliation, endorsement, or sponsorship by the trademark owners.
9. Availability and Modifications
BPS Dynamic (PTY) Ltd reserves the right to modify, suspend, or discontinue any part of the application at any time, with or without notice. We may update quiz content, features, scoring systems, or other elements of the application as we see fit.
We do not guarantee uninterrupted or error-free access to the application. The application is provided on an “as available” basis.
10. Disclaimer of Warranties
ClickOps is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
BPS Dynamic (PTY) Ltd does not warrant that the application will be uninterrupted, error-free, secure, or free of harmful components. We do not warrant the accuracy, completeness, or reliability of any content, including quiz questions and answers.
ClickOps is an educational game and should not be relied upon as the sole preparation material for any AWS certification exam. We make no guarantees regarding exam outcomes.
11. Limitation of Liability
To the maximum extent permitted by applicable law, BPS Dynamic (PTY) Ltd and its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of goodwill, arising from or related to your use of or inability to use the application.
In no event shall the total liability of BPS Dynamic (PTY) Ltd exceed the amount you have paid to us in the twelve months preceding the claim, or R500 (South African Rand), whichever is greater.
12. Indemnification
You agree to indemnify, defend, and hold harmless BPS Dynamic (PTY) Ltd, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including legal fees, arising from your use of the application, your violation of these terms, or your violation of any rights of a third party.
13. Termination
BPS Dynamic (PTY) Ltd reserves the right to suspend or terminate your account and access to the application at any time, without prior notice, for any reason, including but not limited to violation of these terms or engagement in conduct that we determine to be harmful to other users or to the application.
Upon termination, your right to use the application ceases immediately. Provisions of these terms that by their nature should survive termination will remain in effect, including intellectual property, disclaimers, limitation of liability, and indemnification.
14. Privacy
Your use of ClickOps is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the application, you consent to the practices described in the Privacy Policy.
15. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of South Africa, without regard to conflict of law principles. Any disputes arising from these terms or your use of the application shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.
16. Changes to These Terms
BPS Dynamic (PTY) Ltd reserves the right to update or modify these Terms and Conditions at any time. Changes will be effective upon posting within the application or on our website. Your continued use of the application after any changes constitutes acceptance of the revised terms.
We encourage you to review these terms periodically. If a change is material, we will make reasonable efforts to notify you through the application or by email.
17. Severability
If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
18. Entire Agreement
These Terms and Conditions, together with the Privacy Policy, constitute the entire agreement between you and BPS Dynamic (PTY) Ltd regarding your use of ClickOps and supersede any prior agreements or understandings.
